Kercsmar Feltus & Collins has extensive experience handling appeals in both state and federal courts. In addition to responding to appeals for our own clients following a trial, we also handle appeals where our firm was not previously involved at the trial level. Our services range from evaluating the merits of a potential appeal to handling the entire matter through completion of the appellate process. Our appellate attorneys possess an intimate familiarity with appellate procedures and persuasive writing and the experience necessary to deal with complicated records and novel legal issues. We have experience in the Arizona state appellate system, the United States Supreme Court, as well as the Ninth and Federal Circuits. Kercsmar & Feltus also boasts three attorneys admitted to the United States Supreme Court, the highest court in the country.
Representative Cases
- Represented a nonprofit client in front of the United States Supreme Court
- Prevailed on appeal in front of the Federal Circuit Court of Appeals for a client that had obtainined a judgment against a patent infringer
- Represented one of the largest excavating companies in the southwestern United States in preserving materialman’s liens worth millions of dollars in front of the Arizona Court of Appeals
- Successfully defended a jury verdict in favor of a large hotel investment and management company before the Arizona Court of Appeals
- Obtained a full defense verdict in favor of a nation bank in a reverse mortgage dispute, then preserved that verdict in an appeal before the United States Court of Appeals for the Ninth Circuit
- Represented a major producer of cosmetic botanical ingredients in two trademark appeals before the United States Court of Appeals for the Federal Circuit
- Represented a design patentee before the United States Court of Appeals for the Federal Circuit in one of the first cases to construe the Egyptian Goddess decision
- Represented the Arizona State Legislature before the United States Court of Appeals for the Ninth Circuit in the SB1070 litigation
- Successfully represented a major producer of industrial gasses before the Delaware Supreme Court
